Article 1: Definitions

In these Terms:

Terms and Conditions: The rules and conditions set out here that apply to all services, products and use of the Website related to From Dusk Till Dawn.

Organizer: Geestdrift vzw, a non‑profit association registered in Belgium, responsible for producing and managing From Dusk Till Dawn (Address: Sente Clarenhof 16/402, 9050 Gentbrugge, BE 0788.912.084).  

Event: The From Dusk Till Dawn event series in 2025, including all affiliated days, stages, and festival experiences produced by the Organizer.

Attendee: Any individual in possession of a valid Admission Ticket and present on the Event premises.

Admission Ticket: The official digital or physical proof that grants entry to the Event, purchased through authorised ticketing channels.

Website: The official From Dusk Till Dawn website and any associated sub‑pages and platforms, accessible at https://fromdusktilldawn.be.

Article 2: Scope and Acceptance

• These Terms and Conditions apply to all uses of the Website, ticket purchases, interactions with the Organizer, and attendance at the Event.
• By accessing the Website, purchasing a ticket, or entering the Event, you agree to abide by these Terms and Conditions.
• The Organizer may modify these Terms at any time. Updated versions will be published on the Website and take effect immediately upon publication.

Article 3: Admission Tickets

• Entry to the Event is only permitted with a valid Admission Ticket.
• Tickets are personal, non‑transferable and non‑refundable unless otherwise stated by the Organizer.
• Tickets must be exchanged for an official Event wristband at the designated entrance point. Without a properly issued wristband, access will be denied.
• Ticket prices include applicable taxes but exclude service and handling fees. The Organizer reserves the right to alter prices or terms without advance notice.

Article 4: Event Location and Conduct

• Access to the Event grounds is only permitted during the official Event opening hours.
• For safety and compliance, attendees may not bring prohibited items such as weapons, illegal substances, glass objects, cans, or other items the Organizer deems dangerous.
• Attendees are expected to follow all house rules and instructions from the Organizer and authorised personnel. Failure to comply may result in denied entry or ejection without refund.
• The Organizer reserves the right to conduct bag checks and personal inspections at entry points.

Article 5: Liability and Risk

• Participation in the Event is entirely at the Attendee’s own risk.
• The Organizer is not responsible for loss, theft or damage to personal property, nor for personal injury, except in cases of proven intent or gross negligence by the Organizer.
• In circumstances beyond the Organizer’s control (including but not limited to extreme weather, pandemics, natural disaster or other unforeseen events), the Organizer may postpone or cancel the Event. In such cases, refunds or compensations are subject to ticketing platform policies and applicable law.

Article 6: Program and Line‑up Changes

• The Organizer reserves the right to alter the Event program, including artist line‑ups, schedules, stage assignments, or locations.
• Such changes do not entitle ticket holders to refunds.

Article 7: Intellectual Property

• All intellectual property related to the Event including logos, visual materials, photos, videos and promotional content; remains the exclusive property of the Organizer.
• By attending the Event, you consent to the use of images, photos or recordings in which you may appear for promotional purposes, unless you have made a formal request otherwise in writing.

Article 8: Privacy and Personal Data

• Personal data is processed in accordance with the General Data Protection Regulation (GDPR).
• The Organizer’s Privacy Policy, available on the Website, explains how data is collected and used.
• Personal data will only be shared with third parties when required to deliver the service or by law, or with explicit consent.

Article 9: Governing Law and Disputes

• These Terms and Conditions are governed exclusively by Belgian law.
• Any dispute arising from these Terms or your participation in the Event will be handled by the competent courts in Gent, Belgium.

ALGEMENE VOORWAARDEN

Artikel 1: Definities

In deze Algemene Voorwaarden:

Algemene Voorwaarden: De regels in dit document die van toepassing zijn op gebruik van de Website, ticketaankopen en deelname aan From Dusk Till Dawn.

Organisator: Geestdrift vzw, een vereniging zonder winstoogmerk opgericht in België, verantwoordelijk voor de organisatie van From Dusk Till Dawn (Adres: Sente Clarenhof 16/402, 9050 Gentbrugge, BE 0788.912.084).  

Evenement: De From Dusk Till Dawn evenementenreeks in 2025, inclusief alle gerelateerde activiteiten.

Festivalganger: Iedere natuurlijke persoon met een geldig Toegangsticket die het evenemententerrein betreedt.

Toegangsticket: Het geldige digitale of fysieke toegangsbewijs voor het Evenement, gekocht via erkende kanalen.

Website: De officiële From Dusk Till Dawn website en gerelateerde platforms: https://fromdusktilldawn.be.

Artikel 2: Toepasselijkheid en Aanvaarding

• Deze Algemene Voorwaarden zijn van toepassing op alle gebruik van de Website en deelname aan het Evenement.
• Door de Website te gebruiken of een ticket te kopen, stem je in met deze voorwaarden.
• De Organisator kan deze voorwaarden aanpassen; wijzigingen worden gepubliceerd op de Website.

Artikel 3: Toegangstickets

• Toegang tot het Evenement is alleen toegestaan met een geldig Toegangsticket.
• Tickets zijn persoonlijk, niet‑overdraagbaar en niet‑restitueerbaar, tenzij anders aangegeven.
• Tickets moeten bij de ingang worden omgeruild voor een officieel bandje; zonder bandje is toegang niet mogelijk.
• Ticketprijzen zijn inclusief btw en exclusief servicekosten. De Organisator behoudt zich het recht voor prijzen aan te passen.

Artikel 4: Festivalterrein en Gedrag

• Toegang tot het terrein is alleen tijdens officiële openingsuren toegestaan.
• Verboden items zijn onder meer wapens, drugs, glaswerk, blikjes en andere gevaarlijke objecten.
• Festivalgangers moeten de huisregels en aanwijzingen van personeel opvolgen; bij overtreding kan toegang worden geweigerd zonder terugbetaling.
• De Organisator mag tassen en personen controleren bij de ingang.

Artikel 5: Aansprakelijkheid en Risico

• Deelname is volledig op eigen risico.
• De Organisator is niet aansprakelijk voor verlies, diefstal of schade aan persoonlijke eigendommen of voor letsel, behalve in geval van opzet of grove nalatigheid.
• In geval van overmacht kan het Evenement worden uitgesteld of geannuleerd; restitutie is afhankelijk van de ticketingvoorwaarden en wetgeving.

Artikel 6: Programmawijzigingen

• De Organisator kan wijzigingen aanbrengen in line‑up, tijden of locaties.
• Zulke wijzigingen geven geen recht op restitutie.

Artikel 7: Intellectuele Eigendom

• Alle rechten op content van het Evenement blijven bij de Organisator.
• Je stemt in met het gebruik van beeldmateriaal waarop je zichtbaar bent voor promotionele doeleinden, tenzij schriftelijk anders overeengekomen.

Artikel 8: Privacy

• Persoonsgegevens worden verwerkt volgens de GDPR.
• Het Privacybeleid op de Website legt uit hoe data wordt gebruikt.
• Data wordt niet gedeeld zonder jouw toestemming, tenzij wettelijk vereist.

Artikel 9: Toepasselijk Recht en Geschillen

• Op deze voorwaarden is Belgisch recht van toepassing.
• Geschillen worden voorgelegd aan de bevoegde rechtbank in Gent.
